All terms below apply to all invoices so please read in full before a deposit is paid and work commence a deposit is an acknowledgement of entering into a contract agreement between the customer named in the invoice and Restyle Pro Ltd and you are happy to proceed with the quote given.
Deposit and Cancellation Policy
1. Deposit Requirement
Upon paying the deposit this is an agreement of the invoice/contract, the Customer agrees to pay a non-refundable deposit to secure the services and a start date agreed in the invoice provided by Restyle Pro Ltd.
2. Cancellation by Customer
In the event that the Customer decides to cancel the services for any reason, the Customer acknowledges and agrees that the deposit paid is non-refundable. The Company will retain the deposit to cover administrative costs and lost opportunities of income resulting from the cancellation.
3. Failure to Provide Services
The only circumstance under which the Customer may be entitled to a refund of the deposit is if the Company fails to provide the agreed-upon start date or services as specified in this contract. In such a case, the Company will issue a full refund of the deposit to the customer within 14 days.
4. Acknowledgment
Paying the deposit the Customer acknowledges that they have read, understood, and agreed to the terms of this Deposit, Deposited and Cancellation Policy.
Payment Due Date:
Payment due date is stated on the invoice if payment is not made on this day a reminder will be sent on or after the due date but before day 61. Important On day 61 late payment compensation will be applied under the Late Payment under section 69 of the county court act 1984 and the debt passed to our external debt collection agency where interest will also be charged from the due date of the invoice until payment is paid. Interest be will claimed at 8% together with compensation at the rate of £80 per invoice and reasonable agency collection fees.
Retention of Title
1. Restyle Pro Ltd retains full title and ownership of the Goods supplied under this Agreement until all amounts due to Restyle Pro Ltd from the Customer have been paid in full, including any interest, costs, or other charges.
1.2. Until ownership of the Goods has passed to the Customer, the Customer shall hold the Goods as a fiduciary agent and bailee for Restyle Pro Ltd and shall store the Goods in a manner that makes them readily identifiable as Restyle Pro Ltd property.
1.3 The Customer shall not sell, assign, or otherwise dispose of the Goods until ownership has passed to the Customer, without the prior written consent of Restyle Pro Ltd.
2. Right to Enter Premises
2.1. In the event of the Customer insolvency, failure to pay any sums due under this Agreement, or if Restyle Pro Ltd reasonably believes that the Customer is about to default on its obligations, Restyle Pro Ltd shall have the right to enter the Customers premises (or any other location where the Goods are stored) without notice to the Customer for the purpose of recovering the Goods.
2.2 The Customer hereby grants Restyle Pro Ltd permission to enter its premises and to remove the Goods without any liability on the part of Restyle Pro Ltd for any damage caused in exercising this right, provided that such entry and removal is conducted in a reasonable manner.
3. Risk and Insurance
3.1 The risk in the Goods shall pass to the Customer upon delivery of the Goods to the Customers premises.
4. General Provisions
4.1 This clause shall survive the termination of this Agreement and shall remain in effect until all amounts due to Restyle Pro Ltd have been paid in full.
4.2 This clause shall be governed by and construed in accordance with the laws.
